Terms and Conditions of Use concerning Online Applications for the Issue of a Carnet de Passages en Douane by ADAC e.V.


ADAC e.V., Hansastr. 19, 80686 Munich (in the following “ADAC”), is the provider of the online application service for the issue of a Carnet de Passages en Douane (“Service”). The functions of the Service are available to you (m/f/o) as a user (“User”) free of charge, subject to any restrictions or requirements set out in these Terms and Conditions of Use. Applications for the issue of a Carnet des Passages en Douane (for short: "Carnet") do not themselves incur any costs. However, applicants must pay a fee for the issue of a Carnet. The following terms and conditions apply to use of the Service:

A. General information on Use
The Service is open to ADAC members and to persons who are not (yet) ADAC members. Use of the Service in itself does not constitute any entitlement to ADAC services or vis-à-vis ADAC. Whether and to what extent you are entitled to ADAC services shall depend, among other things, on the conditions applicable to the issue of a Carnet. Exclusively ADAC shall review the existence of performance requirements for the actual issue of a Carnet.

You will receive an email confirming receipt of your application after accepting the ADAC Terms and Conditions for the Issue of a Carnet de Passages and having read the data protection information (DPI) and the additional information on applying for and using a Carnet de Passages and after sending a binding application for the issue of a Carnet by clicking on the "Order and Pay Now" button. This confirmation email merely acknowledges receipt of the application and does not constitute acceptance of your application by ADAC. Your Carnet de Passages will be issued in accordance with your application as soon as you receive another email confirming that your application has been approved by ADAC. For further information, kindly refer to the ADAC Terms and Conditions for the Issue of a Carnet de Passages, which otherwise remain unaffected by these Terms and Conditions of Use.

B. Availability
The Service is offered subject to availability. ADAC endeavours to ensure 24/7 access to the Service. There is no entitlement to use the Service in the event of disruptions to the Service or internet connectivity issues. Temporary interruptions to operation due to normal maintenance times, system-immanent disruptions to the internet at third-party network operators and in the event of force majeure are possible. Furthermore, ADAC offers the Service in regard to its type and scope on the basis of the current technical, legal and commercial terms governing the internet. ADAC is entitled to discontinue the service at any time, even without prior notice. It is at the discretion of ADAC to commission a third party of its choice with provision of the Service. There is no legal entitlement to obtain and use the Service. ADAC is entitled furthermore to restrict, expand or amend its performance in connection with use of the Service at any time. Adjustments of this nature may occur in particular in response to changes in the technical, legal or commercial terms for use of the internet – especially where these affect areas outside the responsibility of ADAC – which make it materially more difficult or no longer reasonable for ADAC to operate the Service.

C. Telephone and data connection
An internet connection is necessary for use of the Service. Costs incurred for the internet connection and, where applicable, for telephone calls and callbacks depend on the User's network operator/provider and shall be borne by the User.

D. Further legal information
Any and all improper use of the Service is prohibited. Kindly use the Service only to the extent permitted by law and in accordance with our Terms and Conditions of Use. ADAC reserves the right to exclude you from using the Service and to take further legal action if you violate applicable German law or our Terms and Conditions of Use.
The ADAC e.V. Tourism Department continuously upgrades the Service in accordance with legal requirements and updates the information on an ongoing basis.

Any use of copyrighted content, in particular by reproduction or dissemination, including in electronic form, as well as storage in database systems or on the internet or intranets, shall be prohibited without the prior consent of ADAC, unless otherwise stipulated by copyright law.
All rights to the content provided, in particular the rights of use and exploitation under copyright law, are the exclusive property of ADAC vis-à-vis the User.
Unless otherwise specified in these Terms of Use, the User is not authorised, without the prior consent of ADAC, to modify, sell, rent, reproduce, use or disseminate information or other content of the Service for purposes other than those specified in these Terms and Conditions of Use, or to make it available to third parties in any other way. Except where special permission is granted under copyright law, the User is not authorised to modify, reverse engineer or otherwise attempt to obtain the source code of the Service, neither may the User extract or attempt to extract parts of the Service.
Where trademarks, names and logos are shown, we would like to point out that these may only be used by the owner of the respective trademark, unless otherwise stipulated by the applicable protective laws. The ADAC e.V. logo is a protected trademark. Any use by parties other than ADAC e.V. requires the prior written consent of ADAC e.V.
Where the content is provided by external partners and not by ADAC itself, this shall be indicated in the respective detailed descriptions.
ADAC reserves the right to take legal action in the event of misrepresentation of the identity of the User of the Service or other misrepresentations when using the Service.
Despite all due care on the part of ADAC and its partners, there may have been changes since the information and data were entered in or transferred to the ADAC systems. ADAC is therefore not responsible for the currency, accuracy or completeness of the information provided. The external links included with some content offer an additional source of information for Users. The operators of the linked websites and/or services are solely responsible for their content.
The following shall apply where ADAC has, in the provision of its Service, set links to pages on the internet whose content and updating process it is unable to influence: ADAC has no influence on the design and content of external websites. ADAC therefore distances itself from all external content, even if it has set a link to these external internet pages.

E. Amendment of the Terms and Conditions of Use
ADAC is entitled to amend these Terms and Conditions of Use at any time due to changes in the legal situation, rulings of the highest competent court or market circumstances or to reflect an expanded or modified functionality of the Service. ADAC shall notify the User in good time of any amendments to the Terms and Conditions of Use that apply to the User, insofar and inasmuch as the User is directly affected by a change in usage operations relating to the Service.

F. Online dispute resolution
The European Commission provides a platform for the online resolution of disputes. This platform is available at http://ec.europa.eu/consumers/odr. Consumers may use this platform to resolve their disputes. ADAC is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
